Truck theft leads to alleged assault

Two men are facing separate felony charges in Island County Superior Court.

A truck theft resulting from a possible misunderstanding led to a fight and a threat at the SPiN Cafe in Oak Harbor last week, according to court documents.

As a result, two men face separate felony charges in Island County Superior Court.

On Jan. 23, 38-year-old Steven Graham reported to police that his maroon 1997 Ford F-250 pickup was stolen after he parked it at the SPiN Cafe on Southwest Barlow Street. The cafe is a nonprofit that provides daytime shelter, food and other services to homeless and low-income individuals.

The following day, a resident reported that 53-year-old James D. Matlock attempted to give him the pickup because he heard the police were looking for it, according to an officer’s report on the incident. The police found the pickup parked near the post office and returned it to Graham.

The police located Matlock, who explained that he borrowed the truck from the owner several months before and that he abandoned it at a grocery store parking lot after he received a trespass admonishment preventing him from returning to the business, the report states.

The owner of the truck was able to retrieve it after it sat in the parking lot for a month and sold it to Graham. But then Matlock saw it parked in the SPiN lot and claimed he wanted to return it to the man he borrowed it from, the report states.

The police arrested Matlock on suspension of vehicle theft.

Then on Jan. 26, the police were called to SPiN Cafe on a report of an attempted stabbing involving Matlock and Graham.

Matlock reported to police that he was sitting on a bench next to SPiN when Graham hit him on the arm, causing him to fall backward. He said Graham yelled that he was going to kill him and started throwing punches, the report states. Matlock pulled out a knife and cut Graham on the hand, causing Graham to run inside SPiN.

Graham told an officer that he intended to fight Matlock for stealing his truck, the report states. He was arrested.

Matlock appeared in court on Jan. 27. The judge found probable cause existed to believe he committed the crimes of felony harassment and assault in the fourth degree. The judge set his bail at a $5,000 bond or $1,000 cash.

Prosecutors charged Matlock in Island County Superior Court Jan. 28 with theft of a motor vehicle. The judge released him on his personal recognizance.
