A Langley man accused of domestic abuse refused to speak with a deputy about the allegations because of the officer’s gender, court documents state.

Prosecutors charged Franklin Smith, 46, in Island County Superior Court March 6 with felony harassment, malicious mischief and two counts of fourth-degree assault.

The assault and malicious mischief charges were filed as domestic-violence-related counts.

On March 3, the alleged victim went to the south precinct of the Island County Sheriff’s Office and asked Sgt. Laura Price about getting a protection order against Smith, who is her estranged husband.

She claimed that Smith had assaulted her previously and they were separated, according to the report.

She said she became alarmed when she saw Smith drive up while the man was there; she asked him to leave through the back door, the report states.

Smith allegedly called the woman names, broke her glasses, hurt her hand, and  jumped over a counter and screamed in her face, the report states.

According to Price’s report, the Smith threatened to kill the man who was leaving the house.

Deputies went to Smith’s home and took him into custody. They told Price that Smith refused to talk to her about the case because she’s female, Price wrote.
