A 31-year-old Oak Harbor man will be going to prison for repeatedly violating a court order to stay away from his ex-girlfriend, according to court documents.
Jay Whitmore pleaded guilty in Island County Superior Court May 7 to felony violation of a court order.
Judge Vickie Churchill sentenced him to one year and one month in prison, which was the recommendation the prosecution and defense worked out in a plea bargain. She also ordered him to pay $1,217 in fines and fees.
Under the terms of the plea bargain, Whitmore’s prison sentence doesn’t start until June 4.
Whitmore was arrested after he confronted his ex-girlfriend and her boyfriend in the Oak Harbor Walmart parking lot Aug. 24 of last year. A judge had approved no-contact orders preventing him from contacting the woman or the children.
Whitmore pushed the man and tried to start a fight with him, the police report states. Whitmore, however, said he just wanted to speak with his children, who were with his ex-girlfriend.
Whitmore’s criminal record includes other domestic-violence crimes, including two prior court order violations, harassment and fourth-degree assault.
