A 29-year-old Oak Harbor man who stole a pink box of donuts from Safeway last fall was sentenced to jail.

Under a plea bargain, Jeffrey Hurt pleaded guilty in Island County Superior Court March 16 to third-degree theft.

Judge Vickie Churchill agreed with the joint recommendation from the prosecution and defense. She sentenced Hurt to 360 days in jail with 155 days suspended. That’s a seven-month sentence, but Hurt could have to serve the entire year if he doesn’t follow court orders.

The judge ordered him to pay $1,117 in fines and fees; also, she ordered him to stay away from Safeway.

Hurt was originally charged with second-degree burglary and third-degree theft, which could have led to a three-year prison term if he was convicted. Hurt’s criminal history increases the sentencing range considerably.

Last August, an employee at the Safeway in Oak Harbor reported that a man, later identified as Hurt, took a box of donuts and left without paying.

The woman said she called to him and he stopped, mumbled something and ran toward the Plaza Cinema.

An officer spotted the box of donuts and found Hurt hiding nearby. The officer confirmed that Hurt had been issued a trespass warning barring him from entering the store.
