A 42-year-old Sedro-Woolley man is facing a felony charge in Island County Superior Court after allegedly being caught driving under the influence for the fifth time, court documents state.
Prosecutors charged William Shuler in Island County Superior Court Aug. 11 with felony DUI and obstructing a law enforcement officer. He pleaded not guilty at an Aug. 22 hearing.
Under state law, a DUI can be charged as a felony if the defendant has four or more prior DUI convictions in the last 10 years. Court documents state that Shuler has four DUI convictions since 2002.
According to court documents, Trooper Chris Merwin with the Washington State Patrol was patrolling on Highway 525 on South Whidbey the night of Aug. 9 when he saw a GMC Safari van speeding. He clocked the van at 70 mph in a 55 mph zone.
Merwin got behind the vehicle and pulled it over after seeing the van cross the centerline. The trooper contacted Shuler, who initially gave him a false name.
Merwin arrested Shuler after he failed roadside sobriety tests. At the jail, Shuler’s blood-alcohol level was tested at 0.114 and 0.119, while 0.08 is the legal limit, the report states.
If convicted of the charges, Shuler could face more than three years in prison under the standard sentencing range.
