The daughter of a man who died from an allergic reaction in 2005 recently filed a wrongful death lawsuit against a former doctor at Naval Hospital Oak Harbor.
Cindy Roberts, a Snohomish County resident, filed the complaint in Island County Superior Court against Dr. Robert Rookstool and PhyAmerica Government Services, a foreign corporation that contracts with the Navy to provide medical services. In addition, the complaint names other ER personnel as “John Does 1-50.”
Through Seattle attorney Joel Cunningham, Roberts filed the complaint as a personal representative for her father, James Hill.
The complaint states that on June 11, 2005, Hill went to the emergency department of Naval Hospital Oak Harbor, located on Whidbey Island Naval Air Station.
“Emergency department personnel did not treat an allergic reaction appropriately, causing Mr. Hill’s death,” the lawsuit alleges.
The complaint asks for damages for pain and suffering; disability and death; lost wages; and funeral expenses.
Kim Martin, base spokesman, said she couldn’t comment on the litigation, but she confirmed that Rookstool no longer works at the ER.
