A 27-year-old man currently serving time in a Nevada prison is wanted on a $100,000 warrant out of Island County Superior Court.
Michael Davis is accused of raping a 15-year-old girl after she passed out at an Oak Harbor home more than two years ago.
Prosecutors charged Davis Aug. 5 with rape in the second degree.
Detective Teri Gardner with the Oak Harbor Police investigated the case. She wrote in her report that the 15-year-old girl was at a home with Davis and two other people March 18, 2006.
The girl passed out from consuming alcohol. She claimed that she regained consciousness to discover that Davis was having sex with her, but then apparently passed out again, the report states.
Davis spoke to the detective and denied that he had sex with the girl or touched her below the waist.
The investigation included two separate DNA tests. A forensic scientist at the State Patrol Crime Lab examined the girl’s underwear and found DNA that closely matched Davis’ DNA profile in the state database.
Gardner located Davis in a Nevada prison. A detective in Carson City obtained a search warrant to take a DNA sample from Davis. That was sent back to the crime lab, where scientists matched it with DNA from the underwear, the report indicates.
If convicted of the charge, Davis could face more than 12 years in prison under the standard sentencing range. The range is higher for defendants who have a felony history. His criminal history includes convictions for communicating with a minor for immoral purposes, forgeries and car theft, court documents state.
